Terms of Service

These Terms of Service govern your use of Frugalista, a personal expense tracking app for iPhone and iPad. By using Frugalista, you agree to these Terms.

Frugalista is a lightweight budgeting and expense logging tool. It is not a bank, accountant, tax advisor, investment advisor, legal advisor, credit counselor, or emergency financial service.

If you do not agree to these Terms, do not use the app.

1. The Service

Frugalista lets you manually log expenses and earnings, assign categories, view monthly summaries, use iCloud sync where available, use Apple Shortcuts/App Intents, and use supporting features such as voice logging and currency conversion.

Features may change over time. Some features may be experimental, in beta, limited by device capability, require iCloud, require network access, or be added or removed. Where required by law, Frugalista will provide notice or obtain consent for material changes.

2. Your Responsibility for Your Data

  • You are responsible for the transactions, notes, categories, shortcuts, automations, and other content you enter or cause to be entered into Frugalista.
  • You are responsible for checking that amounts, dates, currencies, categories, voice parsing results, exchange-rate conversions, and summaries are accurate enough for your own use.
  • You are responsible for maintaining backups, managing iCloud settings, and protecting access to your Apple ID and devices.
  • You should not enter highly sensitive information unless you are comfortable storing it in the app and, where enabled, syncing it through iCloud.

3. No Financial, Tax, Legal, or Professional Advice

Frugalista provides tools for recording and viewing information. It does not provide professional advice and should not be relied on as the sole basis for financial, tax, legal, accounting, investment, borrowing, insurance, employment, or business decisions.

Any totals, charts, categories, summaries, currency conversions, voice-parsed transactions, suggestions, or future AI outputs are informational only. You should verify important information independently and consult a qualified professional when appropriate.

4. Accuracy and Availability

  • Manual entries may contain mistakes.
  • Voice transcription and parsing may misunderstand you.
  • Shortcuts or Wallet automations may pass incomplete or incorrect data.
  • Currency exchange rates may be delayed, estimated, unavailable, cached, rounded, or different from rates used by banks, card networks, merchants, or tax authorities.
  • iCloud sync may be delayed, unavailable, conflict with other device changes, or fail because of Apple account, network, device, or service conditions.
  • The app may contain bugs, and the service may be interrupted, changed, or discontinued.

5. License to Use Frugalista

Subject to these Terms, Frugalista grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the app on Apple-branded devices that you own or control, as permitted by Apple Media Services terms and the App Store rules.

6. Acceptable Use

  • Do not use Frugalista in a way that violates law or infringes anyone's rights.
  • Do not attempt to reverse engineer, copy, resell, sublicense, or exploit the app except where law expressly allows it.
  • Do not interfere with Frugalista's server-side services, Apple services, or other infrastructure.
  • Do not use automated systems to overload, scrape, probe, or abuse Frugalista services.
  • Do not submit malware, secrets, credentials, card numbers, illegal content, or other content that you do not have the right to process.
  • Do not misrepresent Frugalista outputs as professional advice or official financial records.

7. iCloud, Devices, and Apple Services

Frugalista relies on Apple platform services such as iCloud, App Store distribution, App Intents, Shortcuts, and device permissions. These services are provided by Apple, not Frugalista.

Your use of Apple services is governed by Apple's own terms and policies. Frugalista is not responsible for Apple ID issues, iCloud availability, App Store availability, device settings, Apple service outages, Apple policy changes, or data handling controlled by Apple.

8. Third-Party and Server-Side Services

Frugalista may use service providers and APIs to operate features, including Cloudflare for server-side hosting, exchange-rate providers for currency data, and OpenAI for voice transcription, transaction parsing, monthly reports, and report chat.

When you use AI voice logging after accepting the in-app disclosure, you authorize Frugalista to send the recording and related voice context to those providers for transcription and transaction parsing as described in the Privacy Policy.

Frugalista is not responsible for third-party service outages, rate limits, pricing changes, provider errors, provider data, or provider terms. Third-party services may change or stop working, and Frugalista may replace them at any time.

9. Subscriptions and Paid Features

Frugalista may offer a Frugalista Pro auto-renewable subscription that unlocks paid AI features such as AI voice logging, AI monthly reports, and report chat. Manual logging, Shortcuts/App Intents logging, categories, multi-currency basics, and iCloud sync may remain available without Pro unless the app clearly states otherwise.

Purchases and subscriptions are handled through Apple's App Store payment system unless otherwise stated. Pricing, trials, renewals, cancellation, refunds, billing, family sharing, taxes, and payment methods are governed by Apple and the App Store terms.

You can manage or cancel App Store subscriptions in your Apple ID subscription settings. Deleting the app does not necessarily cancel a subscription. Refund requests are handled by Apple where required by App Store rules.

Paid AI features are subject to fair-use limits and technical rate limits so the service remains reliable. Launch limits may include 400 AI voice parses per month, 3 saved AI reports per month, and 100 report chat replies per month for Pro users. Each completed report month can have one saved AI report, and Frugalista does not offer report regeneration. Free sampling limits may include 20 successful AI voice parses lifetime, 1 successful AI monthly report lifetime, and 10 successful report chat replies lifetime.

Frugalista may verify App Store subscription status before allowing paid AI features. If subscription verification fails, is unavailable, expires, is refunded, or is revoked, paid AI features may be limited until entitlement is restored.

10. User Content

You retain ownership of the information you enter into Frugalista. You grant Frugalista the limited permission needed to store, process, display, sync, parse, convert, and otherwise operate the app features you use.

You represent that you have the right to enter and process the content you add to the app. You are responsible for any consequences of entering, sharing, exporting, deleting, or relying on that content.

11. Privacy

Frugalista's Privacy Policy explains how the app handles data. By using Frugalista, you also agree to the Privacy Policy.

12. Data Loss and Backups

Frugalista is not a guaranteed backup service. Device loss, app deletion, iCloud settings, sync conflicts, user actions, software bugs, Apple service issues, or other events may cause data to be lost, duplicated, delayed, changed, or unavailable.

You are responsible for keeping any records you need for taxes, reimbursement, accounting, audits, legal compliance, or other important purposes outside of Frugalista.

13. Disclaimers

To the maximum extent permitted by law, Frugalista is provided as is and as available, without warranties of any kind, whether express, implied, statutory, or otherwise.

Frugalista disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, quiet enjoyment, non-infringement, and that the app will be uninterrupted, secure, error-free, or meet your needs.

14. Limitation of Liability

To the maximum extent permitted by law, Frugalista and its developer will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; lost profits; lost revenue; lost savings; loss of data; data corruption; business interruption; reputational harm; tax consequences; financial decisions; or costs of substitute services.

To the maximum extent permitted by law, Frugalista's total liability for any claim related to the app or these Terms will be limited to the greater of the amount you paid to use Frugalista in the 12 months before the claim or 10 USD.

Some jurisdictions do not allow certain limitations of liability. In those places, the limitation applies only to the maximum extent permitted by law.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Frugalista and its developer from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your use of the app, your content, your violation of these Terms, your violation of law, or your infringement of another person's rights.

16. Termination

You may stop using Frugalista at any time. Frugalista may suspend, limit, or terminate access to any server-side feature if you violate these Terms, abuse the service, create legal risk, or if the feature is discontinued.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, Apple terms, and dispute-related provisions.

17. Changes to the App or Terms

Frugalista may update the app and these Terms from time to time. Changes may be made to reflect new features, legal requirements, service providers, or business needs. Continued use after updated Terms become available means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, except that mandatory consumer protection laws in your country of residence may also apply.

19. Apple-Specific Terms

  • Apple is not a party to these Terms and is not responsible for Frugalista or its content.
  • Apple has no obligation to provide maintenance or support services for Frugalista.
  • To the extent any warranty exists under law and is not effectively disclaimed, Apple's responsibility is limited to refunding the app purchase price, if any, as required by Apple's standard terms.
  • Apple is not responsible for claims relating to Frugalista, including product liability claims, legal compliance claims, consumer protection claims, intellectual property claims, or claims arising from your use of the app.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific terms against you.
